Terms and conditions

These terms govern the use of AV3D Studio, the 3D design, planning and simulation service for audiovisual events provided by Estudio Fenix Software S.L. (“we”, “us”). To create an account or log in you must accept them, together with the Privacy policy.
1. What AV3D Studio is
AV3D Studio is a web application to build an event in 3D before you reach the venue: projection, LED screens, lighting, sound, rigging and staging in real meters, with their calculations, equipment lists and reports. It runs in the browser and needs no installation.
The editor can be used without an account: projects are then stored only in your browser. With an account they are stored on our servers, you can open them from any computer and, depending on your plan, work with other people in real time and use the marketplace.
There is a free plan and paid plans. What each one includes is on the pricing page and may change; if a change affects you while you are paying for a plan, we will tell you before it applies.
2. Your account
Give accurate details and keep your password safe: you are responsible for what is done through your account. If you log in with Google, we identify you through your Google account.
You must be of legal age or have permission from your legal representative. Each account belongs to one person; to work as a team, other people are invited to the projects.
There may be a free trial of a paid plan, with no card. When it ends, the account moves to the free plan on its own and nothing is charged unless you subscribe to a plan.
3. Your content
The projects, 3D models, drawings, images, logos and data you create or upload remain yours. You allow us to store, copy and process them only to provide the service: keeping them in the cloud, generating thumbnails and reports, and showing them to the people you share a project with.
If you publish an object or a project in the marketplace, you also accept the declaration shown when publishing: that you are its author or hold the rights needed to share it, and that you are responsible for its content. We review it before it is shown; once published, other users can see it, download it and use it in their projects, with your name as the author. You can withdraw it at any time and so can we; what others have already copied into their projects may stay there.
Do not upload content you are not allowed to share: protected material without permission, personal data of other people you should not process, or someone else’s confidential information.
4. Acceptable use
You may not:
- try to access other people’s accounts or projects;
- overload, probe or tamper with the service, or get around the limits of your plan;
- resell access to the service without a prior agreement with us;
- use the application for anything illegal or harmful to others.
5. Calculations and data sheets
The calculations in AV3D Studio (optics and distances, lux, pixels, blending, sound pressure, rigging loads, weights and power) are based on the data in your scene and in the equipment data sheets. They help you plan the setup; they are not a certificate.
Catalog data sheets are approximate until they are checked against the manufacturer. Before building anything, check the data against the manufacturer’s documentation and have a qualified person review everything that affects safety, especially hanging points, loads and electrical installation, according to the regulations of the venue.
6. Plans, payments and cancellation
Paid plans are charged in advance, monthly or yearly, through Stripe. Prices are shown without VAT: any VAT due is calculated at checkout, based on your billing address and, if you buy as a business, your VAT number.
Invoices are issued by Estudio Fenix Software S.L. and are available in your account, under Billing.
You can change or cancel your plan at any time from My subscription. If you cancel, the plan stays active until the end of the period already paid and then you move to the free plan.
Periods already started are not refunded unless the law says otherwise.
If a payment fails, the account has the limits of the free plan until it is resolved. Your projects are not deleted.
7. Availability
We work to keep the service available and your data safe, but we cannot guarantee that it will always run without interruptions or errors. There may be downtime for maintenance or for reasons beyond our control.
The service is provided as is. Projects and objects stored only in your browser depend on it: if you clear its data, they are lost.
8. Liability
To the extent permitted by law, our liability is limited to the amount you paid for the service in the twelve months before the event giving rise to it, and we are not liable for damage resulting from using the calculations or the data sheets without the checks described in section 5.
None of this limits liability that cannot be excluded by law, such as liability for willful misconduct or personal injury.
9. Closing your account
You can ask us to delete your account through the contact page. We may suspend or close an account that breaches these terms, giving notice beforehand whenever possible.
Deleting the account removes your cloud projects, their versions and your private library, except what we must keep by law, such as invoices. If you want to keep a project, download it first from the editor with Export project.
10. Changes to these terms
We may update these terms; the date of the last review is shown above. If a change is significant, we will tell you with reasonable notice by email or inside the application. Every time you log in you accept the current version.
11. Governing law
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Barcelona, unless consumer rules set a different venue. Before getting there, write to us through the contact page and we will try to sort it out.
